Prosecutors decided after 30 years to withdraw the indictment against Hintonowi since admitted that the evidence is not sufficient to prove his guilt.

Hinton was arrested and sentenced to death in 1985. He was charged with murder during a robbery of two fast-managers operation. He was then 29 years. The main evidence against him, which the prosecution had was the witness of the third attack on the restaurant, which recognized him as the attacker.

Hinton, who is African-American, was sentenced, even though he had an alibi – during raids worked in the warehouse, where he was seen by many people .

His situation which already looked hopeless, improved in the last year, when the US Supreme Court held that defense counsel of the accused during the trial there were up to the task and are guilty of multiple failures. At the end of this week Hinton was acquitted.

Attorney Bryan Stevenson, who heads the organization of the Equal Justice Initiative of Alabama, said that the issue of Hinton is a “textbook example” of what is wrong in the American judicial system.

– We have a system that is not doing the right thing, when such action is obvious. Prosecutors should order the testing of ballistic many years ago. I think it’s shameful. That’s what happened this week, should occur at least 15 years ago – said Stevenson.

– I should not sit on death row for 30 years – said Hinton after release. – They wanted to make a judgment on me for something I did not do, and all you had to do is examine the weapon – he added.
