Alexander Orlov from the mid-90s described the cases of corruption in Odessa and other Ukrainian regions. Through its activities – as report the representatives of the Foundation Open Dialog, who repeatedly intervened in his case – exposed to numerous influential activists linked with the Party of Regions and former President of Ukraine Viktor Yanukovych. In 2011, he was arrested on suspicion of murder .
Dealing with him was – according to activists – chaotic “festival of incompetence” . Relying on information provided by the accused and after hearing the lawyers of the materials of the investigation, the Foundation informed, among others of torture against Orlov, violation of his civil rights and “unbearable conditions of detention” , which had lead to the deterioration of his health condition.
Discussed also conducting an investigation into the Orlova by persons without investigative powers and irregularities in subsequent court sessions, which many times due to the absence of representatives of the prosecutor were canceled. It was also stressed that the accumulated evidence did not permit even to formulate charges against Orlov .
The Foundation said that in the night from Wednesday to Thursday, there was another, 155, meeting the Ukrainian court on Orlov. While it – as we read on the Foundation Open Dialog – “the first time the prosecutor has not blocked the request of defense to change the preventive measure to house arrest, and even supported him” . Decision Odessa prosecutors Orlov after nearly five years of residence in the detention center was released, so that during the process will be able to respond with a free rate of .
from our perspective, success was that Orlov could finally get out of jail, to meet with his family and that his life will not be threatened. The fight for innocence is the next step – commented Thomas Czuwara Foundation Open Dialog .
Ukrainian system is not fair to the citizens. It is highly politicized, independent and does not safeguard the justice. The very fact that the matter Orlov will be examined according to this system, it is dangerous. It is dangerous also that people, which is endangered, writing about incorrect acquisitions and corruption , all the time are influenced and still at liberty – he added.
Czuwara also he recalled that before the accused of the murder of the head of the bus station, where he worked Orlov , a few years earlier also accused him of drug possession. In connection with the protraction of the process, the European Court of Justice in the Hague awarded him compensation.
The case of murder is not therefore the first chapter of persecution Orlov by the Ukrainian judiciary. Everything – including the method of preparation of the indictment and the evidence at the start of the investigation – indicates that Orlov is obsessed with political views – says a board member of the Foundation.
In the case Orlov engaged the Polish and the Ukrainian authorities. On the Polish side, among others, they intervened Members – including Margaret Gosiewska (PiS) and Marcin Święcicki (PO) , who visited the accused in custody and – within the framework of the parliamentary mission – watching the process. The case has also become a journalist on March 10 B. R. discussed during the meeting of the Parliamentary Committee for Liaison with Poles Abroad.
Guarantees for Orlov – as pointed out Mr Michael Dworczyk (PiS) – has made a number of deputies of the Ukrainian Supreme Council, including Pavlo Kostenko and Oleksandr Urbańskij . In Odessa intervened as President of the Supreme Council Oksana Syroid and former head of the Ukrainian Foreign Ministry Borys Tarasyuk . According Dworczyk, that is they have a key impact on changing the preventive measure.
However, as stipulated involved in the case Dworczyk, the involvement of Polish politicians does not mean that they consider him innocent. – As parliamentarians and representatives of the Polish authorities, we believe simply that no Polish citizen should not be detained without trial for such a long time – commented.
last was seen speeding up proceedings against Orlov. I think that contributed to this mobilization of our diplomacy, both at the governmental and diplomatic, interparliamentary – emphasized Dworczyk. – A week ago, during a visit to Kiev, as representatives of the group met bilaterally with a number of major Ukrainian politicians, we talked about the case Orlov. Most importantly, we met the new Prosecutor General Yuri Lutsenko, who was himself experienced by the regime of Yanukovych, during the reign of the detained and accused Orlov – he added.
no doubt change in the position of the Prosecutor General good sign that promises to beginning the process of change in the Ukrainian Prosecutor’s Office. This has so far been one of the most serious problems of the neighboring state. I believe that what happened tonight is the announcement of upcoming changes – he stressed.
It is not known the date of the next court hearing on Orlov.
