At the European Parliament’s website published the texts of the four draft resolutions on Polish. On Wednesday will vote on the issue.
First, critical of the Polish government’s project has gained the support of the largest faction in the European Parliament: European People’s Party ( which include, among others PO), the Party of European Socialists, liberal ALDE and Greens. These fractions together have more than 500 votes in the 751-seat European parliament.
At the beginning of the resolution stated that the key PE is considered to ensure that the “common European values referred to in Article 2 of the TEU are fully respected. ” In a similar vein maintained second point, in which the EP believes that all Member States must fully comply with EU law in their administrative practices and legislative. “Applicable countries legislation should reflect the fundamental European values such as democracy, the rule of law and respect for fundamental rights. In the framework of these principles should be formed to the right.
“PE is seriously concerned”
“The European Parliament is seriously concerned that the actual paralysis of the Polish Constitutional Court is a threat to democracy , human rights and the rule of law “- we read in the third point of the resolution. the fourth point is the call of the Polish government to” respect, publication and full implementation without further delay the Constitutional Court’s judgment of 9 March 2016. and to implement the judgments of the days 3 and 9 December 2015. “

The ability to further control the rule of law by the EC
The European Parliament also expressed its support for the decision of the European Commission on the start of the structured dialogue under the Rule of Law Ram. EP calls on the Commission to launch the second stage of the procedure control of the rule of law by issuing “recommendations on the rule of law” and to offer their support Poland in the development of solutions to strengthen the rule of law “in the case, if the Polish government does not meet the recommendations of the Venice Commission during the structured dialogue.
the European Commission is called upon to regularly and thoroughly inform Parliament of its assessments, made progress and actions taken. the dialogue between the Polish government in the European Commission has a basis to look at the other decisions of the authority, which can “raise concerns about violations of the law” .

Motion conservatives
the second draft resolution made members of the European Conservatives and Reformists (ECR), which includes, among others, Law and Justice MEPs. As emphasized by MEPs, their project was created after taking into account, among others, the founding treaties of the European Union, the Polish Constitution, the Law on the Constitutional Tribunal of June 25, 2015, as amended, of the Rules of Parliament, the opinion of the European Commission and the Venice Commission.
also noted that the current Polish Government is the strongest democratic mandate since the overthrow of communism. The resolution also stressed that the changes introduced by the Act taken June 25, 2015 by the previous government were aimed at a choice of five judges before the parliamentary elections, which was defined as “made a last-minute change of formations of the Court.” Also included a provision of the Act, according to which each newly elected judge must take an oath before the President.
Wines previous government
The resolution stresses that “changes in the Tribunal adopted on 25 June 2015. and a selection of five Judges, on 8 October 2015 years just before the parliamentary elections 25 October 2015 the year are a source of ongoing controversy surrounding the Constitutional Court. ” The authors also note that “previous government secured an overwhelming majority of 14 out of 15 judges TK, thereby violating elementary principle of pluralism in the courts, which is contrary to the recommendations of the Venice Commission in 1997.”
MEPs note that “changes in the Tribunal introduced by the government of Law and Justice are intended to simplify the proceedings before the Court and provide clearer rules of constitutionality, as well as reduce the” too broad discretionary powers of the President of the Constitutional Tribunal in this regard. “

the third project and appealed to Orban
the third draft resolution submitted Stanislaw Żółtek on behalf of the least numerous factions in the Parliament – People’s Europe and Freedom (ENF). The three-point draft resolution is based on, among others, about the words of the Hungarian Prime Minister Viktor Orban, who said that “the European Union should not think of applying any sanctions against Poland, since it would require full unanimity and Hungary will not support any sanctions against the Polish”.
The authors take into account the fact that the EU is not possible or powers to interfere in the internal politics of Member States. According to members of the ENF, the European Commission has reacted improperly, criticizing the democratic choice of the citizens of Europe after the elections and referenda in other Member States, and now the new Polish government faced a similar situation.
The first point resolution, MEPs recall that the Commission is not a political body, but the executive body of the EU. The second point was a record of a solemn commitment to the overarching principles of identity and national sovereignty, which constitute an indivisible whole with the principle of freedom.

the fourth draft resolution was submitted by the fraction Europe of Freedom and Direct Democracy (EFD), which includes, among others, MPs Congress of the New Right. It highlights the rich Polish history, marked by many examples of struggle for freedom and sovereignty as well as the commitment to demokracji.Zauważono that the media activities of the President of the Constitutional Tribunal and his statement deepen the conflict and making it difficult to reach a compromise on the functioning of the Constitutional Court.
it is also noted that the crisis TK was initiated when the ruled the PO-PSL coalition. Next, MEPs stress that the guidelines of the Venice Commission are not binding and may or may not be accepted.
In the text of the resolution stressed that the crisis around the TK is an internal issue of Polish and can be resolved only by the Polish government in dialogue with stakeholders. According to the authors of the project, the situation does not require intervention from the Commission and other EU institutions, and any interference is not justified. MEPs EFD point out also that the actions taken by the Commission concerning the Polish government are politically motivated and used by the opposition to deepen the impression of political chaos in Poland.
