12.04. Strasbourg (PAP) - The European Parliament has adopted on Wednesday a resolution on the crisis over the Constitutional Tribunal in Poland. The initiators of the majority of the project, backed by five of the eight factions in the European Parliament, ensure that the resolution is an expression of concern for Poland.

EPL submitted a draft resolution on Poland together with the Socialists, Liberals, Greens and the Left; together these fractions are 577 MEPs. Separate projects are reported in a population of 75 representatives of the group of European Conservatives and Reformists, to which the PiS, Eurosceptics fraction of the Europe of Nations and Freedom (38 MEPs) and the group Europe of Freedom and Direct Democracy (46).

"I want to note that we are not against Poland, against the state. We are concerned about the rule of law" - said Tuesday the head of the largest faction in the European Parliament, the European People's Party, Manfred Weber.

"We are worried the situation in Poland, we worry about the people in Poland and European values. The Venice Commission, and even American partners publicly express criticism of the new Polish government" - he added Weber.

"We need a strong Polish EU, but unfortunately the new government is going through, which makes this strong Polish we lack. Poland today is silent, because the new government violates the values of the EU and is not active in European politics" - said Weber, who is a politician of the German CSU.

According to Weber's key demand formulated in the resolution is to "maintain the separation of powers in Poland, namely the full restoration of the rights of the Constitutional Court."

He recalled that a few years ago, similar discussions were held about Hungary. "But then Prime Minister Viktor Orban was willing to change the law under the European Commission's proposals, even when it came to the constitution," - said the politician. "Such an attitude would expect from the Polish government. We do not want Poland to dictate anything, but talk to Polish. However, I would expect that the opinions of the Venice Commission, neutral experts, will be implemented" - said Weber.

Also, the leaders of the Socialist Gianni Pittella and liberals, Guy Verhofstadt stressed that the key is to implement the opinion of the Venice Commission on the Constitutional Tribunal Act, by which he asked the Polish government. "It is no interference in the autonomy of the Polish government by the EP" - Pittella told reporters. He expressed the hope that the support of a broad majority in Parliament for the resolution "will be the political signal" for the Polish government.

Majority draft resolution focuses on the crisis around the TK, but as a result of treatments Socialists and Greens was added to the record of "other problems" that seriously disturb the European Parliament, because it "can violate European law and fundamental rights, including women's rights. " This should include on the last initiative to tighten Polish anti-abortion laws.

As stated by the leader of the Greens Rebecca Harms, the issue of abortion laws is undoubtedly an important issue from the point of view of its factions. "But you can see that the debate on this subject in Poland is not initiated by the government but by an organization close to the Church. This is an important but separate issue. It seems to me that if the separation of powers and the Constitutional Court in Poland again begin to function well, it it will be easier to resolve some other issues "- assessed the German MEP.

Majority draft resolution states that the EP is seriously concerned about the paralysis of the Constitutional Court in Poland, which could threaten democracy, human rights and the rule of law. It urges the Polish government to the publication of judgments of the Court and the implementation of the opinion of the Venice Commission of the Council of Europe on the amendment of the Constitutional Tribunal Act. PE also call on the European Commission to implement the second phase of the procedures for the protection of law against the Polish, if the government in Warsaw did not respect the recommendations of the Venice Commission.

With the second amendment EP resolution, submitted on behalf of the European Conservatives and Reformists by MEP Ryszard Legutko (PiS), estimates that the cause of the crisis around the TK in Poland are the decisions of the previous Sejm, who chose the five judges of the Court. The project EKR also states that the government can not publish the "resolution" TK of 9 March 2016, adopted "in breach". It emphasizes that the crisis can be resolved through responsibility and willingness to compromise of all political forces.

"You have to give reasons other and illuminate the entire complexity of the situation," - said the PAP Legutko. "We are dealing with a deep constitutional crisis in Poland. A parliamentary majority (EP) considers that one side is right total, and the other did not have" - he added.

According Legutko supported by the majority of the draft resolution comes down to the fact that "it is good, when one political party had an absolute majority in the TK". In his opinion, the EP resolution has no effect. "This is not a binding document, and will confirm many in the belief that it is malice and bias on the part of PE" - rated.

eurosceptic faction Europe of Nations and Freedom in the EP, the core of which is the far-right National Front, Marine Le Pen, made the third draft resolution on the situation in Poland. It stressed that the EU can not interfere in the internal affairs policies of the Member States.

The fourth project received from the Eurosceptics of the Europe of Freedom and Direct Democracy, which includes, among others, UK Independence Party (UKIP) Nigel Farage. The project emphasizes that the crisis around the TK is an internal affair of Polish and the EU and its institutions have no right to interfere in it.
